صدر مملکت جنرل پرویز مشرف نے پاکستان الیکٹرانک میڈیا ریگولیٹری اتھارٹی آرڈیننس مجریہ دو ہزار دو میں مزید ترمیم کا آرڈیننس جاری کر دیا۔ (تفصیلی خبر):
اسلام آباد (اردو پوائنٹ تازہ ترین، 3 نومبر 2007) صدر مملکت جنرل پرویز مشرف نے پاکستان الیکٹرانک میڈیا ریگولیٹری اتھارٹی آرڈیننس مجریہ دو ہزار دو میں مزید ترمیم کا آرڈیننس جاری کیا ہے جو فوری طور پر نافذالعمل ہو گا۔ صدر مملکت نے آئین کے آرٹیکل 89 کی شق 1 کے تحت تفویض اختیارات استعمال میں لاتے ہوئے یہ آرڈیننس جاری کیا ہے اور اس کے تحت آرڈیننس 2002ءکی دفعہ 20 میں ترمیم کی گئی ہے اس دفعہ کی شق ڈی میں قواعد کے لفظ کے بعد ضوابط شامل کئے جائیں گے، شق ایچ کے آخر میں لفظ اور ہو گا کو حذف کیا جائے گا، شق آئی میں آخر میں فل سٹاپ اور سیمی کولن کا اضافہ ہو گا اور نئی شق اس طرح ہو گی۔ خود کش بمبار حملوں، دہشت گردوں دہشت گردی کا شکار ہونے والے افراد کی لاشوں، تشدد پسندوں اور انتہا پسند عناصر کے اعلانات اور دیگر ایسی کارروائیوں جس سے کسی طرح دہشت گردوں یا دہشت گردی کی سرگرمیوں کو فروغ یا معاونت ملتی ہو، جاری نہ کی جائیں۔ (شق کے) کے تحت اس بات کو یقینی بنایا جائے کہ کوئی اینکر پرسن معتدل مزاج یا میزبان کسی طرح کوئی ایسی رائے یا اقدام نہ کرے جس سے کسی طرح نظریہ پاکستان اور پاکستان کی خود مختاری، یکجہتی یا سلامتی کیلئے کوئی تعصب پیدا ہو۔ شق آئی کے تحت ایسا کوئی پروگرام براڈ کاسٹ نہ کیا جائے جس سے امن و امان برقرار رکھنے کے منافی کوئی اقدام منافرت یا تشدد کو ہوا ملے۔ شق ایم کے تحت کوئی ایسی بات براڈکاسٹ نہ کی جائے جس سے سربراہ مملکت، مسلح افواج کے ارکان، ایگزیکٹوز، مقننہ یا عدلیہ کیلئے کوئی برا نام آتا ہو یا اس کی تصدیق ہوتی ہو۔ شق او کے تحت کوئی ایسی بات براڈکاسٹ نہ کی جائے جو غلط، بے بنیاد یا بدنیتی پر مبنی ہو یا کوئی ایسی بات جس سے اس بات کے یقین کی وافر وجوہات ہوں کہ ایسی کوئی بات غلط، بے بنیاد یا بدنیتی پر مبنی ہے۔ آڈیننس 2002ءکی دفعہ 25 میں ترمیم کے تحت اس کی شق ڈی میں لفظ تنظیم کے بعد الفاظ بشمول کوئی غیر ملکی ، غیر سرکاری تنظیم شامل کیا جائے گا۔ آرڈیننس کی دفعہ 27 میں ترمیم کے تحت لفظ آپریٹر کے بعد یا اونر شامل کیا جائے گا۔ دفعہ 27A میں ترمیم کے تحت جو نئی دفعہ شامل کی جائے گی، اس کے تحت ایسا فرد جو براڈکاسٹ میڈیا لائسنس یا لینڈنگ رائٹس پرمیشن جاری کرے، وہ اپنے ایئر ٹائم کی فروخت کیلئے کسی غیر ملکی براڈکاسٹر کے ساتھ کوئی معاہدہ نہیں کر سکے گا اور نہ ہی اتھارٹی کی پیشگی اجازت کے بغیر کسی غیر ملکی براڈکاسٹر کو ایئر ٹائم فراہم کرے گا۔ آرڈیننس 2002ءکی دفعہ 29 میں ترمیم کے تحت ذیلی دفعہ 6 میں قید کی میعاد کے ساتھ لفظ ایک کی جگہ لفظ دس شامل کیا جائے گا جو تین سال تک یا ایک کروڑ روپے جرمانہ یا دونوں کے ساتھ ہو سکتی ہے، کوئی بھی ڈسٹری بیوشن لائسنس ہولڈر یا اس کا نمائندہ جو آرڈیننس کی کسی شق کی خلاف ورزی کرے یا اس کی خلاف ورزی پر اکسائے تو اسے ایک سال قید یا 50 لاکھ روپے جرمانہ یا دونوں سزاﺅں کے ساتھ قابل سزا ہو گا۔ آرڈیننس 2002ءمیں دفعہ 34 شامل کی جائے گی۔ اس آرڈیننس کے تحت جرائم قابل دست انداز اور کمپاﺅنڈ ایبل ہوں گے۔ آرڈیننس 2002ءکی دفعہ 34A کو حذف کرنا، اس آرڈیننس میں دفعہ 34A حذف کی جائے گی۔
========================== President General Pervez Musharraf on Saturday promulgated two Ordinances amending laws related to the print and the electronic media, prohibiting them to publish or broadcast statements that abet terrorist activities or terrorism.
The ordinances to amend the Press, Newspapers, News Agencies and Books Registration Ordinance 2002 and the Pakistan Electronic Media Regulatory Authority Ordinance 2002 will be effective with immediate effect.
In the Ordinance dealing with press a new section 5A has been inserted which prohibits publication of certain material; photographs of suicide bombers, terrorists, bodies of victims, statements of militants and extremist and any other thing which promotes or abets terrorist activities or terrorism.
The section also prohibits projection of any thing that is based on sectarianism, ethnicism or racialism, that defames, and brings into ridicule or disrepute the head of state, or members of the armed forces or executive, judicial or legislative organs of the state.
It also prohibits any material that is likely to jeopardise or be prejudicial to the ideology of Pakistan or the sovereignty, integrity or security of Pakistan, besides any material, that is likely to incite violence or hatred or create interfaith disorder.
Under the ordinance, in a situation of emergency, the district co-ordination officer, or the deputy commissioner may suspend the declaration for a period not exceeding 30 days.
The ordinance dealing with the electronic media similarly prohibits broadcast video footage of suicide bombers, terrorists, victims, statements of militants or anything that abets terrorism.
It also directs the channels to ensure that no anchor, moderator or host propagates any opinion that is prejudicial to the ideology of Pakistan or integrity of Pakistan.
The amendment prohibits broadcast of any material that defames or brings into ridicule head of state, members of armed forces, executive or legislative or judicial organs and any programme on a matter this is subjudice. A new insertion also prohibits foreign broadcasts.
The authority or the chairman under a new sub-section may seize broadcast or distribution equipment and seal the premises and in an emergency may direct closure for a period as it may determine.
It also prohibits live coverage of incidents of violence and directs installation of time-delay equipment to prevent any such violation. The violators shall be punishable with imprisonment for a term that may extend to three years or with a fine, which may extend to ten million rupees, or with both. The distributors who violate may face imprisonment of up to one year or fine which may extend to five million rupees, or both.
